The purpose of this document is to inform the natural person (hereinafter the “Data Subject”) regarding the processing of their personal data (hereinafter “Personal Data”) collected by the data controller, Sveva D'Acquisto, Milan, Tax Code DCQSVV78S61E507L, VAT Number 10503870965, email address info@likehomemilano.it (hereinafter the “Controller”), through and ____________________ (hereinafter the “Application”).

Any changes and updates will be binding as soon as they are published on the Application. If the Data Subject does not accept the changes made to this Privacy Policy, they are required to cease using the Application and may request the Controller to delete their Personal Data.

Categories of Personal Data Processed

The Controller processes the following types of Personal Data voluntarily provided by the Data Subject:

  • Contact data: name, surname, address, email, phone number, images, authentication credentials, any additional information provided by the Data Subject, etc.

  • Tax and payment data: tax code, VAT number, credit card information, bank account details, etc.

The Controller processes the following types of Personal Data collected automatically:

  • Navigation and usage data of the Application: such as visited pages, number of clicks, actions taken, session duration, etc.

  • Data relating to the exact location of the Data Subject: for example, geolocation data that precisely identifies the Data Subject’s location, which may be collected via satellite network (e.g., GPS) and other means, collected with the Data Subject’s consent. The Data Subject may withdraw consent at any time.

Failure by the Data Subject to provide Personal Data for which there is a legal or contractual obligation, or where they are necessary to conclude the contract with the Controller, will make it impossible for the Controller to establish or continue the relationship with the Data Subject.

A Data Subject who communicates Personal Data of third parties to the Controller is directly and solely responsible for the origin, collection, processing, communication, or dissemination of such data.

Cookies and Similar Technologies

No cookies are used to transmit personal information, nor are persistent cookies or tracking systems for the Data Subject used. Therefore, the Application does not acquire the Data Subject’s Personal Data through these technologies. Session technical cookies (non-persistent) are used strictly to ensure safe and efficient navigation of the Application.

Legal Basis and Purpose of Processing

The processing of Personal Data is necessary:

  • For the execution of the contract with the Data Subject, specifically:

    • to fulfill any obligation arising from the pre-contractual or contractual relationship with the Data Subject

    • support and contact with the Data Subject: to respond to the Data Subject’s requests

    • payment management: to process payments by credit card, bank transfer, or other instruments

  • For compliance with the law, specifically:

    • to fulfill any obligation provided by current regulations, laws, and rules, in particular concerning tax and fiscal matters

  • On the basis of the legitimate interest of the Controller, for:

    • marketing purposes via email for the Controller’s products and/or services, to directly sell the Controller’s products or services using the email provided by the Data Subject in the context of selling a product or service similar to that being sold

    • management, optimization, and monitoring of the technical infrastructure: to identify and resolve technical problems, improve the Application’s performance, and manage and organize information in a computer system (e.g., server, database, etc.)

    • statistical purposes with anonymized data: to perform statistical analyses on aggregated and anonymized data to analyze the Data Subject’s behavior, improve the products and/or services provided by the Controller, and better meet the Data Subject’s expectations

  • Based on the Data Subject’s consent, for:

    • profiling of the Data Subject for marketing purposes: to provide information on the Controller’s products and/or services through automated processing aimed at collecting personal information to predict or evaluate preferences or behavior

    • retargeting and remarketing: to reach the Data Subject with personalized advertisements who has already visited or shown interest in the products and/or services offered by the Application using their Personal Data. The Data Subject may opt-out by visiting the Network Advertising Initiative page

    • marketing purposes for the Controller’s products and/or services: to send commercial and/or promotional information or materials, to carry out direct sales of the Controller’s products and/or services, or to conduct market research through automated or traditional methods

    • detection of the exact location of the Data Subject: to detect the presence of the Data Subject, monitor access, times, and presence in a given location, etc.

Based on the Controller’s legitimate interest, the Application allows interactions with external platforms or social networks, whose Personal Data processing is governed by their respective privacy policies, which should be consulted. Interactions and information acquired through this Application are in any case subject to the privacy settings chosen by the Data Subject on such platforms or social networks. This information – in the absence of specific consent for further processing – is used solely to allow the use of the Application and provide the requested information and services.

The Data Subject’s Personal Data may also be used by the Controller to protect itself in legal proceedings before competent courts.

Methods of Processing and Recipients of Personal Data

Personal Data is processed using paper and IT tools, organized and processed strictly for the purposes indicated and adopting appropriate security measures.

Personal Data is processed exclusively by:

  • persons authorized by the Controller who have committed to confidentiality or have a legal obligation of confidentiality;

  • entities operating independently as separate data controllers or designated as data processors by the Controller to carry out all processing activities necessary to achieve the purposes described herein (e.g., business partners, consultants, IT companies, service providers, hosting providers);

  • entities or authorities to whom disclosure of Personal Data is required by law or by order of authorities.

The above entities are required to use appropriate safeguards to protect Personal Data and may access only what is necessary to perform their assigned tasks.

Personal Data will not be indiscriminately disclosed in any way.

Location

Personal Data will not be transferred outside the European Economic Area (EEA).

Retention Period of Personal Data

Personal Data will be kept for the time necessary to fulfill the purposes for which it was collected, specifically:

  • for purposes related to the execution of the contract between the Controller and the Data Subject, they will be retained for the duration of the contractual relationship and, after its termination, for the ordinary statute of limitations period of 10 years. In case of legal dispute, for the duration of the dispute until all appeal terms have expired

  • for purposes related to the legitimate interest of the Controller, they will be retained until such interest is fulfilled

  • to comply with legal obligations, authority orders, and legal protection, they will be retained in accordance with the timelines provided by such obligations and laws, and in any case until the statute of limitations expires

  • for purposes based on the Data Subject’s consent, they will be retained until consent is withdrawn

At the end of the retention period, all Personal Data will be deleted or stored in a form that does not allow identification of the Data Subject.

Rights of the Data Subject

Data Subjects may exercise certain rights regarding the Personal Data processed by the Controller. Specifically, the Data Subject has the right to:

  • be informed about the processing of their Personal Data

  • withdraw consent at any time

  • restrict the processing of their Personal Data

  • object to the processing of their Personal Data

  • access their Personal Data

  • verify and request correction of their Personal Data

  • obtain limitation of the processing of their Personal Data

  • obtain deletion of their Personal Data

  • transfer their Personal Data to another controller

  • lodge a complaint with the supervisory authority for Personal Data protection and/or take legal action

To exercise these rights, Data Subjects may send a request to info@likehomemilano.it. Requests will be handled by the Controller immediately and processed as soon as possible, in any case within 30 days.
